Apple Pay Liability


i'm trying understand incoherent policies of local supermarket (a member of albertson's llc megacorp) regarding apple pay. many american merchants, they're tardy accepting emv "chip-and sign" cards. hardware in place, haven't got software ready yet. means that, since october 2015, liable credit card fraud perpetrated @ registers.

however, far can tell, not liable apple pay transactions. according vp of card issuer's bank: “the bank has liability purchases made when apple pay offered , used form of payment. true both face-to-face , “in-app” purchases.”

has changed i'm unaware of? can merchants possibly on hook apple pay fraud?
 

last heard merchants held liable in-app apple pay purchases due them being considered "card not present" (the same other online purchase). perhaps changed?
